Send a copyright notice
If you own a copyright, or are authorized to act for its owner, send a written notice with:
- Your physical or electronic signature.
- A description of the copyrighted work. For multiple works at one online site, you may provide a representative list.
- The material you believe infringes and enough information for us to find it, such as a page URL, card identifier, or the location within the app.
- Your contact information, including your address, telephone number, and email address if available.
- A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for the owner of the exclusive right involved.
Email the notice to our copyright agent or send it to the postal address above. Please identify it as a copyright notice.
What happens next
We review notices and act promptly to remove or disable access to material when required. We may ask for information needed to locate the material or complete the notice. When content supplied by a user is removed, we take reasonable steps to notify that user.
We may share the notice and relevant contact information with the affected user as part of handling the claim. Include what the notice requires, but avoid unrelated personal information.
If your content was removed by mistake
If you believe your content was removed or disabled because of a mistake or misidentification, you may send our copyright agent a written counter-notice containing:
- Your physical or electronic signature.
- Identification of the removed or disabled material and where it appeared before removal.
- A statement, under penalty of perjury, that you believe in good faith that the material was removed or disabled because of a mistake or misidentification.
- Your name, address, and telephone number.
- A statement consenting to the jurisdiction of the Federal District Court for the district where your address is located. If you are outside the United States, consent to the jurisdiction of any Federal District Court district where Bold Vibes Labs LLC may be found.
- A statement that you will accept service of process from the person who submitted the original notice or that person's agent.
We forward a valid counter-notice, including its contact information, to the original complainant. Under the DMCA process, we restore eligible material between 10 and 14 business days after receiving a valid counter-notice, unless our agent first receives notice that the complainant has filed an action seeking a court order to restrain the alleged infringement.
Knowingly making a material misrepresentation in a notice or counter-notice can lead to liability for damages, costs, and attorneys' fees. Read 17 U.S.C. § 512 for the statutory process.
Repeat infringement
We terminate, in appropriate circumstances, the accounts of users who are repeat infringers. We review notices, responses, and relevant account history when applying this policy.
